I am the HOA President in a 189 member single family community. I have long felt it's a better to convert the HOA to a POA. This conversion only requires our BOD's approval and not a member vote. Since last December, when our new 3 person Board was voted in, I have made several attempts to convince the BOD to convert to a POA.

I have provided them with an indepth report entitiled "The reasons why a community should adopt the Georgia POA act" as well as other articles and emails I've gotten from our management company and a couple other local communities that converted. No luck. I've been outvoted twice.

Should I just leave this issue alone or is there some other persuavive argurment I can offer my two board members??

First, it's so important to respect the reality of the power of a board majority, even when one is in the minority. By "respect" I mean accept the decision and move on (for now).

Second, it looks to me like subjecting the community to the Georgia POA Act is in the community's best interests. But that's just myself.

Third, are you sure the board can make this decision? All the signs I am seeing are that the owners have to vote to amend the Declaration et cetera to make the community subject to the Georgia POA Act. To me, it makes sense that the owners (not the board) would have to vote on this to make it reality.

In several states, there are "master", "community", and "property" associations. Are they governed under different statues as planned communities?

If you are willing to share, please sanitize (remove HOA names, etc.) the paper first or ask for emails to email it to those interested.
