Want to state that we are a manufactured home over 55 neighborhood. We have a HOA and Social Club. This question applies to the SC, but could also be a question other HOA members might want an answer for.

Our Social Club became dormant during the covid era. A member of the community, not a homeowner, as he lives with his mother, has attempted to revive the Social Club. Events have been held each month this summer. He has formed a committee, and about 6 of us were voted out last night as we do not agree with his actions. This fellow does not have any intention, I believe, to officially, reactivate the SC. He has said nothing about holding elections. He intends to go along with himself being the 'acting' president. The issue is that he is giving orders to our Treasurer to cut checks. She is the treasurer prior to covid, (no other officers still around). He has lost money on the events he has run. We are now getting into more expensive events to run, such as our annual picnic in Sept., and he has made a depost for the Christmas party. He makes these decisions without any vote of the committee, however, the committee really has not power, as none of them have been elected, except for the treasurer. I am afraid our $4000 balance in the bank will soon be zero.

We are frustrated as we do not know how to get rid of him, and restart the Social Club with an election. Can anyone give us suggestions?

Someone is going to have to lay the ground work for an election. What do your Bylaws say about an elected Board Of Directors?

If your governing docs define the social club as part of the HOA, then this person's actions have no weight whatever. Typically the board would have take action in order to re-activate committees and whatnot. Your comment about elections being required supports my belief that this is the case.

But read your governing docs carefully to see what they say about your official social club and how it is supposed to operate.

If my take on things is correct, the board needs to do its job, exercise the proper oversight, tell the treasurer to knock it off unless the board approves the expenditures, and notify the community that this current "social club" is not official. If it sounds like enough people want to get social activities going again, the board needs to step up and re-activate the official group, elections and everything.

You may have a fight on your hands, but it has to happen.

I agree that a careful study of this HOA's Declaration, Articles of Incorporation and Bylaws is essential to identifying the steps to take here. Without knowing a lot more about what the latter "governing documents" say about, for one, the Social Club's relationship to the HOA corporation, I think concrete feedback is not possible.
