California HOA having difficulities in terminating current managing agent and having agent produce and delivery all association CCC required documents and property to the new agent. Does anyone have any remedies/examples of attorney letters, litigation, similar situation, etc. thanks.

This is a legal question, since it involve a contract.

Ask your lawyer for help.

Next time, insist on a contract that is easy to understand for both parties.

FabianV: Is the Board following all requirements to terminate as stated in the management contract? Also, check out what your state law requires in order to terminate.

IMO, it would not be necessary to go to litigation or incur attorney fees just to transfer records from one management company to another. Why do you think the managing agent is not cooperating with the Board?

Not an altogether rare situation. What you can do depends on your state's law and the terms and conditions of the contract. You need a lawyer to read the contract and give you some advice on how to proceed.
