Our HOA faked a meeting to get approved by DEO. We challenged it and the DEO threw out their previous approval. Now after a formal questionaire was sent out, less than 25% of 429 owners want to recertify. My question is this: Can a small group of 50 or 60 property owners recertify just amoung themselves and take posession of all the community assets including the airstrip and clubhouse, that technically now belong to all 429 members...What does the state law require when less than the original number of parcel owners attempt to recertify?? Can the "GROUP" force some parcels to be part of a limited recertification just because their property is subject to the airstrip easements. Has anyone successfully recertified with just a small portion of the original members???...on another issue...our HOA has been collecing unauthorized assessments since 2014 when our documents expired...Now they have a $300k war chest to pay lawyers to do whatever they want...so who does all that money belong to? Should it be refunded to the members who paid under threat of lien? last question: Can board members past and present be held personally liable for spending our money after they knew it was fraudulently collected

How was it fraudalently collected if your incorporated? That is what allows a HOA to collect funds...

After our hoa's restrictions and covenants expired, they lost their authority to collect assessments. What would you call it then, if they dont inform members and continue to send out bills demanding assessments?
