I'm in the process of doing a recall on two members of our Board. I've already written the letter to the owners explaining the reason but have no clue how to format a return document the owners will actually fill out with their vote, date and signature. Has anyone ever gone through this process and if you have would you give me an idea how you dealt with this part of the process. I've done a search on-line and haven't found anything. Thanks in advance.

Hey John, what is the purpose of the recall? Do you have members who will take their seats? When is your next annual meeting? Depending on long till your next annual meeting is due, might be better to wait.

You are not asking for a recall, you are asking for a general membership meeting for the purpose of recalling directors.
You will need to check your governing documents to see how many signatures on the petition you need (note: signatures = lots).

You will also need more then the minimum number required as some could be tossed by the board for various reasons.

The petition at Davis-stirling.com is for Calif. and may not be good in AZ. There still might be useful things to read at that site.

You need to know AZ requirements for recall and whatever might be in your own bylaws. We don't seem to have any regular posters form AZ at this time.

If not too far from your annual election, I agree it'd be best to wait.

What Kerry and Tim said, although I'd start with Kerry. If your annual election is coming up, why not find a few homeowners who feel the same as you and then walk around the neighborhood encouraging everyone to cast a vote against those board members? There's nothing wrong with campaigning for or against someone, but make sure your reasons for voting them out are based upon their performance as board members - don't get personal.

You might also encourage your neighbors to vote for specific people if you like. If you want one of those spots, make your case, again without getting personal, except for telling people a little about yourself, why you're interested in the job and what you'll bring to the position. If you're not running, you should be able to explain why Mrs. X and Mr. Z might be better than the two incumbents. You should discuss your concerns with them first because they probably won't want their names mixed up with something if that something is full of personal insults.

The election results will dictate what happens after that - if they're voted off, congratulations. If not, a specific campaign against them may prompt those board members to do better in the future. If you still want to proceed with your letter, check your documents to see what's necessary for a special meeting and have your like-minded neighbors review it. Some may be better than you at drafting the letter and they can write it. Oh, and all of you should sign it - if you're that upset about the board members' performance, you should be gutsy enough to say who you are.

Recalls are fraught with legal issues and can drag on and on. As suggested, gather a team to run for election and replace those you do not like. Much easier if you are willing to work, and I do mean work, to do it this way.
