Why is this landlord getting short when I complain about their tenant? Am I pushing boundaries?

You can see previous post history, I've owned my downstairs unit for the past 3 years & he's had a problematic tenant for the past 2 yrs. There was another tenant before this one but he never got notices from the HOA/property mgmt, with this crappy tenant she's gotten 2 notices for noise violation. The last one resulted in a fine, another noise violation was sent last week & the process begins again. Now, she's dating this guy that's adding to the noise issue and with the consistency he's visiting, HOA office is potentially sending an unauthorized occupant notice to her. They said they need proof he's visited minimum 14 times, didn't say from a certain date or if it needs to be consistent just 14 all together. I already have 16 from 5/27, the HOA Mgr on site isn't here today so I decided to call her landlord until he returns.

I tried calling him about 2 weeks ago and finally spoke with him today. He told me he had no idea the fine was sent to him he didn't get it, mind you the office confirmed it was sent there was a hearing with the HOA committee back in May. I tried to explain the new noise violation that'll be sent and now she has this guy practically living here that's not on the lease. He seemed to rush me off the phone and I tried to explain as much as I can, he asked for the # for the HOA office (I've given it to him before) and said this'll be resolved. I mean he probably thinks I'm a nuisance but as a landlord wouldn't you want to know if someone is being a nuisance better yet when they have people that are practically living here and aren't on the lease? Plus it's just not a verbal complaint from my end, the office is escalating this & sending out notices. I've mostly been communicating with the office & since she's lived here for a while I'm letting her landlord know directly because he keeps on stating he doesn't get the notices but I know the crappy tenant has gotten them and the office confirms it's sent.

Danielle,

Personally, I don't think you will be happy regardless of who is living in the unit above you.

Your question is am I pushing boundaries?

In my opinion, yes.

Regarding notices: the owner may have gotten them and is trying to be polite to you about the situation.
It's possible that the Association is only sending them to the units address.

Regarding the phone call to the owner: I think you should keep your communications to the HOA.

I agree with Tim 100%. Plus let it rest already. No one's answers has changed since the first time you have posted. Plus you or the HOA can't force the tenant to vacate. That is between the landlord and the tenant. Those the facts...

Apparently violations are brought to attention of owner and tenant, fines are sent directly to owner. Uh hello it seems like I should let the ll know because the HOA is sending it to him and he’s claiming he hasn’t gotten anything.

Danielle,

I am sure that you will do what you believe is best.

You asked for opinions.
I gave you mine.
Others have given you theirs.

The landlord is likely getting short with you because, from their perspective, you are the one being difficult.
You don't have to agree that you are being the difficult one but you should at least see how others might see you that way.

Why do you need to know? Does not speed up the process. The HOA told you they did. So done.

My neighbors have been in violation for their fences for nearly a year now. Plus have done other serious violations. The MC sends them a $25 or $50 fine to fix. I know as I got a notice or two myself for notice. It is none of my business how my neighbors are handling being fine. That is between them and the HOA. I just know on my end they are in violation.
