I have been preparing to list a condo of mine in a medium sized HOA. I know that we have not listed anything but I have spoken to a few neighbors about listing. They have noticed vendors working and painting the place. Etc.

Today I received a large packet from on of the BOARD MEMBERS. I opened it up and it was a solicitation packet seeking business from me when I sell. You see, she is some sort of escrow officer.

I am curious if this is a conflict of interest. I mean this person wouldn’t know who am I am but since she is on the board she does have my contact details. Etc…. Feels weird.

I can’t find anything in DSA. I am just curious if this is just done in poor taste of if it really is a problem.

There is nothing wrong with someone on the Board trying to sell you services.

However, she shouldn't be using inside knowledge that she gains from her Board position to sell you services.

For example, hearing through the grapevine that you are selling and then approaching you is fine. Having the PM notify her of every homeowner who has requested a escrow payoff statement (early insight that they are preparing to sell) and then contacting those homeowners would be a no no.

Perhaps the escrow officer, like others, heard or surmised that you're going to list your condo. I don't think it's even in bad taste if she solicits your business. Did she make it seem it was from the Board or your association?

But, if somehow the Board knows from executive session that you'll be listing IF the board is aware you're in assessment-payment trouble or for some other reason, her behavior might be unethical, since executive session matters must be kept confidential.

I see no conflict of interest.
