Nc law states a homeowner can trim branches from a neighbors tree if the branches are over his yard

A HOA member wants the HOA to cut the tree branches back because the tree is on HOA land. Another wants us to cut grass behind their split fencing. Typical hysterical reasoning is that snakes live in the woods. Cutting. 10’ strip of grass won’t stop snakes from crossing it

I’d rather just let it grow wild and save the HOA money. Only reason to cut tree is if it’s almost dead and is a Safety issue imho

My neighbors tree had branches over my back yard I just cut them down. I’d never think to bother my neighbor and ask him to cut down the tree branches.

The owner of the tree should keep their tree properly trimmed so it does not encroach onto a neighboring property.

Most State laws allow for an owner to cut the limbs of a tree that does encroach onto their property but only at the property line.

So to answer your question as to who is responsible for the tree - that would be the owner.

Keep in mind that failing to maintain the tree can be considered negligent.

You are correct. Branches that extend beyond the property line can be cut by the upset homeowner. The HOA can cut them if they want to but do not have to.
