It is widely understood the Florida covenants (CCR's) are extinguished by MRTA s.712 relieving the parcels owners of any requirements from an HOA or Mandatory Association. However the issue in some cases the complication of the Deeds having the Book and Page of the covenants requiring the start time of the 30 years at the point of the first deed transfer seems a little unfair when one home is free and the neighbor is still bound to extreme HOA requirements. This seems to play in to unbalanced and inconsistent enforcement which is a fundamental structure of the HOA's statute 720. Should this be removed or have the statute changed to the first deed transfer in each unit, that seems more consistent with the intent of the statute. We also need a department of the State to police these HOA's.
