I spoke with the manager on site today & was informed that the hearing committee will have the board fine the tenants landlord/owner of the unit. I posted last that I had a feeling something went down, her boyfriend flicked my camera off & she was frantically pacing up and down the block after the hearing happened. I didn’t attend, the office suggested I shouldn’t go to avoid confrontation & I hoped my documentation would suffice. The property Mgr warned me prior to hearing that the hearing notice wouldn’t guarantee a fine but the second I gave a police report his toned changed. Because this is her first offense, it was $100. And the property Mgr informed me that this is the first time a hearing was held for a noise complaint, at least for the 7 years he’s been there. Realistically speaking, is it likely this fine will keep my shit neighbor in check? Once fine is addressed, the process repeats itself: warning then hearing notice to potentially fine.

I know this has been a major issue for you. Everyone wants to enjoy their home without constant frustrations over things that impact that enjoyment.

Realistically? Who knows.

I would suggest being civil to all your neighbors, regardless if it's in person or behind their back it's best to always be civil.

Define "In check"? Is it to your standards? I mean you are INTENTIONALLY trying to LISTEN to your next door neighbor and then complaining about what "noises" they make. No one can go through life like that on either side...

There’s a big difference between hearing noise when I press my ear against the wall & hearing tv blast from the other end of my apt. I shouldn’t even have to explain myself

Some people are super sensitive to noise. You appear to be one of them. You live downstairs, right? You could install noise reducing ceiling tiles in your unit. Have you thought about that?

It is an invasion of expected privacy. A loud TV is not something that should be a federal case. My TV is set at 30 Max or low as 12. Guess what? I open my door to let the dogs in and can hear it outside. The sound is not set very high at all. Can not say it is loud just because it is heard from an open door or another room. I am sure your neighbors hear yours as well.

What is this camera showing? Meaning if showing areas outside your own property could be illegal.

The first thing officers do when investigating a noise complaint is standing outside the front door to see if noise can be heard from outside. If you’re saying your tv can be heard from outside, that’s going against ordinance right there

Keep in mind that there are reasons why a TV might be considered too loud.
The individual having hearing loss (and not recognizing that fact) is one example.

I'm reminded of this instance from when I was in the military:

One individual in the barracks contently had their stereo on loud.
One day, a package was found at their front door.
The package contained a set of headphones with a note that simply said "please use".
Message was received.

Yeah the way my unit was described is correct, even with the staircase in between the noise still transfers & can be heard in my living room

I lived in an apartment one time with a similar setup. I had a weather alert radio. Was at work one day and got notified by the office. It seems my alert went off that afternoon. My neighbor worked 3rd shift. They made maintenance come into my apartment to turn it off.

I hated that weather alert. It was a gift. My ex wanted to make sure had it on. We were storm chasers at the time. usually they shut off after alert announced by weather service. So only like 10 seconds of alert noise. This one was new and did not know it did not turn off till hit a button.

Apparently my neighbor had a fit when it went off. Enough they had to enter my apartment while I was out. Even got a warning about it. I was a bit shocked considering it was not much louder than a radio. Did not keep it at full volume.

Still have that alert radio. No longer the man who gave it to me. Just weird how such a little thing can set someone off.

You would be shocked at how much you can hear. The structure seems to conduct and amplify sound - plumbing pipes are big offender, and they run through the walls. When I lived in a similar situation, I used to say that I didn't have neighbors, I had roommates - and when my realtor held open houses when I was selling the place, she said "OMG, I couldn't live here."

And that's in a well-constructed building. It must be much worse in cheap construction.

It's why I said in my first response to this endless saga that if you don't like noise, do NOT live underneath someone else. Townhome-style designs are much better, but you will still hear noise. So for those who really are bothered by noise, they need to think twice about living in communal settings at all since noise goes along with the territory.

My point was that Dannielle is putting her ear against a wall to hear what is being said in a phone conversation above her. What wall? The wall that goes to the stairwell? I am growing skeptical of this story.

Could be the stairwell. I once was in a stairwell leading up to a second floor condo (I work for a new home builder) and I could hear a conversation in an adjacent unit like I was in the room with the people. I was shocked.
