Simple question.

We have a homeowner who encroached on an association greenbelt by planting a row of trees to indicate his property line, but the trees row encroached on HOA property by quite a bit. So we sent him a letter asking him to move the trees back to his property.

Homeowner nicely asks for HOA help in finding property line.

My thoughts are that he needs to hire a surveyor. Yes, they are expensive, but no one besides a surveyor can help him.

Anything I am missing?

HOA, or you has the issue. They should be the one to hire the professional. I am sure you can try and bill them for the service, but good luck!

I'm assuming you know where the HOA property line is. As long as he plants the trees behind this line he should be good to go. You do know where the line is, right?

How did you conclude there was encroachment on the first place? Did you look at a map of the property? If so and you know which agency has the maps, tell the homeowner (nicely) to go there (this isn't rocket science).

He/she will probably need to spend the money because Trees don't care about property lines. That said, here's hoping you aren't making assumptions about all this, giving in to your lone ranger behavior (yet again) otherwise you will eat a bucket of fried crowd of you're wrong.

Clearly the Board knows where the property line is. If the HOA attorney agrees, I think the Board should share its knowledge. Otherwise, the game playing will continue.
