Our self-appointed 'property manager' resigned. Apparently, being required to get Board approval before spending Association money was a bridge too far.

Another Owner allowed him to store items belonging to our Association in her garage. She has now demanded the Board remove these items.

It's the position of the Board that her agreement is with the other Owner, Mr. 'PM', and thus is between the two of them to resolve, and the 'PM' should lead this effort as part of his transition.

We've offered to help if the 'PM' requests it; he's been instructed to place whatever he has that belongs to the Association in an Association storage area that's open and accessible to everyone.

Thoughts?

Thomas, I think you've asked previously how to get assn. records held by previous directors and this so-called PM. Well, now someone's begging you to take away records stored in her garage. For cripes sake, grab 'em. Some may be VERY helpful.

Others may have an idea about whether you want to give this woman a "receipt" or some such.

Now also is the time to have all locks changed that the "P.M." had access to. You indicated, I think, that one of more of these areas have things your HOA needed. I assume there's storage for records in one of these areas.

You'd already wondered how to "replace" this PM/handyman so get going on whatever sketchy plans your board has made.

Just to make sure we all understand. You could go get the stuff out of the garage, and move it to an Association storage area. But you believe either the old PM or the lady with the garage ought to do it? That's the extent of the issue?

Every year after the annual meeting, we have the Ceremonial Moving of Association Stuff from one set of garages to another: extra recycling bins, frames for signs, orange cones, some spare siding and shingles... It's a veritable rite of spring around here, and a sign that the changing of the guard has occurred. :-)

Ah, cooperation. How nice that would be, and it's been offered. And it's my understanding what's in there is stuff like this.

This gives me some ideas, though, on how we might go about dealing with the situation. Thanks.

Be careful if that idea includes having a "yard sale". That can be taxable income for a HOA. A HOA is funded by Dues. Anything like a bake sale, yard sale, or other type of fundraisers are subject to taxation.

This is silly and childish.

If you (the current Board, the Association) actually want any the Association property from the one owner's garage or if you actually want any of the other things that the self-appointed 'property manager' may have in his possession, then if you're smart; you will make arrangements for items to be made available at a time/date/place convenient for whoever has possession of them, and you (current Board) will go pick them up.

If you don't actually want any of this stuff, then continue with what you're doing.

Trying to get the now-resigned, self-appointed 'property manager' and this other owner to do anything you want/expect/demand them to do will result in things disappearing forever.

For a few reasons, I think the HOA should just bite the bullet; quit imposing on others' space; and rent a storage unit.
