Criminal investigation on board members - can those board members use POA funds/attorney in defense?

If board members are being investigated criminally, I assume they cannot use POA funds nor the Board's attorneys in any activity around criminal defenses. Is that correct? And if so and if they do use POA funds in any criminal defense efforts what can be done about it?

Is the investigation and alleged criminal activity related to the HOA or is it personal?
