Follow up with noisy upstairs neighbor, any other suggestions I’ve tried everything?

For those familiar with my posts, I’ve owned my downstairs unit for over two years and she’s rented for almost two years. I didn’t like the tenant before her but she’s worse, I’ve tried everything: approaching her, calling cops, have the office send her a warning with police reports, attend HOA meeting and spoke with board, spoke with her landlord/owner before she moved in and he replaced carpets and spoke with attorney. The HOA board pretty much said that they can’t do much, one of the board members I spoke with was an attorney and he made the situation seem more hopeless. An attorney I spoke with on the side suggested I attend meeting in the first place & said there’s a cease and desist letter option but that wasn’t suggested. I hear walking, talking loudly through walls when she has guests over, things slamming etc. Last night she had someone over and she did something that made me flip, when she was by her door she pointed at the camera on my window sill and her friend looked into it and did this stupid dance. That was just petty and I took it as making fun of me, that’s when I had security come by to listen and he will send the noise report to the office. He said he isn’t allowed to knock on her door unless he got permission from the office which I found to be odd. I’m not letting someone get away with this, I’m going to call police over next time, I’ve been avoiding the police because the last time they were here they made it come across like I was exaggerating. I want the office to fine her landlord, the only thing I’ve done to get even on my end is use a ceiling thumper to irritate her.

So your poking the bear and wonder why the bear is poking back? The landlord is the only one that can be fined or addressed for this. They are responsible for their tenant. Send a letter to the landlord/owner to let them know in professional terms what the tenant is doing.

It should be stated that construction could be a factor here. No matter who moves there it's going to sound like a "bowling alley". My best suggestion. Find someone to rent your place or move. Your never going to be happy there. Plus some of it is your own fault for not doing so.

No, you haven't tried everything. To summarize what I've said in the past, nearly all community association solutions will boil down to fix it, live with it, or move. I've also said that if you're bothered by noise, having upstairs neighbors is not a smart choice. You may not want to move, but that's not the same as having no choice - by staying put, you're deciding that you prefer the noise to the aggravation of moving.

Not liking any of your options will not make new options magically appear.

Moving is a last resort I plan to eventually but atm I can’t for financial reasons & I don’t want to make it that easy for her. When you say community associations will boil down to fix it, what do you mean?

Now your just in it for spite. Stating "I don't want to make it easy and make her think she has won" is now your thinking. Guess what? She has already "won" if you keep poking the bear. Your moving has no bearing on their life. It is YOURS.

I lived next door to a neighbor whom constantly complained about my dogs barking. He had 3 yippie yappy poms. I had 4 mixed breed dogs. They were not "Barkers" except at strangers and his dogs. Which they did ONLY briefly. I made sure my dogs were inside the house by 10 pm. Our neighbor was the Animal Control officer. I even video taped my dogs NOT barking or interacting with his dogs. It was well established by authorities/neighbors his dogs were the barkers. He even complained about my dogs barking while they were INSIDE my house! I put up a privacy fence between us so the dogs could not interact.

So no matter what actions I took which included getting rid 2 of the dogs, he still complained. It finally stopped when one day he came over at 4 am in the morning to my front door. Telling me to make my dogs stop barking. (They were not till they heard him at the door) He then threatens me that every time he hears my dogs bark he's going to come over to my house to bang on the door. I looked at him dead in the eye and said "Okay" closed the door. Why? This man is going to get out of bed at 4 am, walk across a wet yard, and pound on someone's door? That my friend is ON him and his own doing.

At one point the problem is YOU. This guy eventually sold and moved. No one else had an issue with my dogs even though every neighbor that moved in had dogs. Do you think I cared one bit he moved and I "Won". Nope. Just glad to stop living in those conditions.

Our front doors? I have it aimed to see when there’s someone at the door, packages & aim it at my car at night
