Unique situation. Homeowners and lot owners in same community. Our board wants to install mailboxes and pay for them using community funds. The lot owners will not included in this expenditure but their dues are being used for the benefit of a select few, the homeowners. What, if any, options do the lot owners have?

What kind of lots are these? Building lots? RV Lots? Do these lot owners receive their mail there? I'm asking because I'm wondering if they did this because the mailboxes are not needed for lots?

Also need Post Office approval of where to put boxes. Or are you just replacing existing boxes?

Building lots which currently outnumber home 2 to 1. These will replace and add to existing boxes. USPS will not deliver mail unless their is a physical structure that is occupied. The concern is using POA funds to provide a service to some property owners but not all, even though all are paying.

I really don't understand this. As long as a mailbox is provided when the house is built why does this matter? To be honest this sounds very petty to me.

That is pretty much how every HOA budget works. You all pay into one budget. Doesn't mean everyone uses everything. Not all benefit but as a group you all do.

I think the concern is whether the Declaration states that mailboxes are common elements that must be maintained by the HOA.

Homeowners pay more. Water is included in their dues as well.

Nothing in Declarations. Mailboxes were added years ago with install paid by all property owners as a service to the homeowners who did not want to pay a yearly USPS rental or drive to the P.O.

I trust you realize that you all should try to pass an amendment to the CCRs to state that the HOA will maintain mailboxes for all lots.

Lot owners most certainly stand on excellent grounds not to pay.

Back to reality, and what I would support if I were on this Board:

-- Immediate refund to lot owners for the amount they paid for the mailboxes (which the covenants do not authorize and which do not serve their lots).

-- Announcement that the HOA will cease to maintain the mailboxes.

-- Taking the pulse of the owners to see who would support an amendment, regarding the mailboxes.
