Our Master Association is asking our Residential Associations to provide an updated list of delegates.

I'll be shamefully honest, I'm not sure how a delegate works. In the sense that - can the board just pick anybody to be a delegate? Or does the unit owner have to be willing to be a delegate first?
How are delegates "picked"? Can board members be delegates? Should they?

TonyN2, ya gotta read the Bylaws and CC&Rs of both the Master and Sub and identify the sections that discuss delegates. Then report back here with what they say.

I know of several such associations that the President of the sub-association is on the Master Association BOD. If not this way in your association, I suggest you do the same. If they want multi Delegates, appoint more BOD Members.

Our By-Laws state that the Residential Association is to pick 4 delagates and 2 alternate delagetes for the Master Association. My question is, who would be willing to do this if we already have a hard time getting board members for our residential board? Do we just elect board members to be delegates?

Tony, what do the delegates do that the Board members do not do? Are they required by the governing documents?

They are required to meet at-least 3 times a year per by-laws, which I don’t think they are doing. Also, they are needed to vote when the master association wants to spend an amount that would cause a big special assessment.

The master association DOES have plans to spend a huge amount and therefore are forced to have a delegate meeting. They realized that delegate lists were way outdated so now we have to pick 6. Problem is, two members of our residential association are also a part of the umbrella board so they are ineligible to be delegates meaning I have to pick other owners.

To me, it appears there is government by confusion. Why don't the Board members be the representatives to the Master Board meeting?
