I have looked for this info and I can't find it. Is there a new law in Texas that says our HOA meetings have to be once a month?

Expecting your HOA is incorporated, check the corporate laws.
Typically, they require a board meet at least quarterly.

Typically, general membership meetings are only once a year as a minimum.

Boards are free to meet more often if needed or desired. They are also free to hold more then the minimum of general membership meetings (these are typically called a special meeting of the membership).

If you mean a meeting of the membership or members (Owners), they usually are once a year for the annual meeting and election. THESE are "HOA meetings." As Tim points, out, there also COULD be special meetings of the membership.

If you mean board meetings, in other words, meetings of the board of directors, TX corporate codes will probably tell you a minimum number, say, quarterly. Many boards meet monthly even if not required by their bylaws or statute. But, read your HOA's Bylaws to see the difference between board meeting and meetings of the membership

Our board meetings. I'm under the impression it's open to all residents at first, and then the board goes into their business afterwards.

Our bylaws say nothing about a monthly meeting, but one board member seems to think we have to have them every month. I'm asking here because, as I said in my first post, I can't find it in a law online. I'm sure it's there, but I'm not a lawyer and can't figure it out.

I will assume this is not a condominium.

No such law exists.

I do not see any requirement for quarterly meetings in the Texas nonprofit corporation statute.

However, Texas statute limits what topics a board may discuss without having a board meeting. Said meeting must be properly noticed to owners. See https://statutes.capitol.texas.gov/Docs/PR/htm/PR.209.htm

Be may have said that because he may have seen other HOAs that do meet once a month. Sometimes people may see something and think that they also have to do the same thing, thinking there's a law somewhere. Why they don't do some research and find out for certain, who knows.

You say your bylaws don't mandate monthly meetings - that's ok, assuming you've read the whole thing. As Kerry noted, you may have read the part about annual meetings which are held once a year. If you still can't find anything, why not ask the board member why he or she would prefer monthly meetings. Maybe he/she has noticed the quarterly or no monthly meeting are too long because you have to packing everything that happened or will happen until the next meeting. Perhaps other homeowners have requested more frequent meetings for the same reason.

Not everything in HOA land is covered by a specific law - otherwise, what's the point of having Bylaws and CCRs? By the way, it's possible there's something in your CCRs about monthly meetings. Usually this is addressed in the bylaws, but strange things happen all the time?

if you still don't find anything, don't over think it. If you're on the board, this may be a good time to discuss whether you are addressing association business in a timely manner with a quarterly meeting or however often you meet. If not, what's wrong with trying monthly meetings for the next 3 or 6 months and see how it goes? There are conversations all over this website with tips on holding productive meetings and you can try a few.

TristaJ, please look at your Declaration and see if it states under which of three main state statutes your HOA falls. Namely:

TPC (Texas Property Code) 209

TPC 81

TPC 82

TPC does include townhome communities if certain criteria are met.

Meetings of the board must be open to owners unless certain topics are to be discussed. At Board meetings that must be open to owners, this means owners can sit and possibly have limited participation, except owners cannot make motions; second motions; or vote on motions.

I see no requirement in any of these statutes for monthly meetings of the board.

Do your HOA's Bylaws say anything about how often board meetings must occur?

What is the date that your HOA's CC&Rs were recorded? It should be on the last page of the CC&Rs.

Our meeting schedule was defined in our Articles of Incorporation document I believe. It stated the day/time we were to have them once a month. It was always a Thursday at 7 PM. Unless there was some type of unusual situation going on, this was the schedule rain/shine.

We had open meetings. Meaning the board sat at the table and held the meeting. The general membership was allowed to watch. After the board was done, we may welcome comments from the floor. We would not use names but lot #'s in reference to members we discussed. The collections reports were just for board members as the nature was of collections. Spending reports were open to any member. We didn't have any closed door meetings. You wanted something you had to present it at the meetings. If you can't state it in front of fellow members you don't want it bad enough.

Ooops, sorry Trista! I guess it IS possible something about Board meetings could be in your articles of incorporation. I think I've heard of more than Melissa's HOA having that info in them.

What size is your HOA?

No. I attended two webinars by two different attorneys covering all the new HOA laws and that is not one of them.
