we have two site men that are employed by our HOA. They frequently are expected to clean gutters and roofs on two-story townhomes. they have NO fall protection. I've looked on the OSHA website but I have only found that it says if work is being done 6 feet and higher, fall protection is required. I am wondering, doesn't our HOA have to provide fall protection to our site men? Are HOAs exempt from providing PPE?

Ditto for the PPE, although you may be able to find the answer to that by calling the health department

I'm new to the board and have asked the current members. They are all clueless. Our previous management company never had anything for them, but they didn't even utilize call waiting. We have a new PM and we have posed the question to them.

Our building maintenance guys go on roofs quite a bit but only if there's a little wall around them. We have one roof with no wall and they cannot go on it as there's no way to secure them.

I'd think your local building dept. would have guidelines for you.

I have an OSHA 10 card, and the only time I need a fall arrestor is climbing poles or working on a cable tv tap. Then I don a step-in 3 point harness. OSHA requires just a belt, but U like the 3pt harness better.
I never had to use a safety belt or harness when I had ladders on the side of houses, buildings, only utility poles.

This is something you should ask a lawyer or your insurance carrier about, then it would be the responsibility of your service provider to be properly licensed and insnared along with workman comp coverage.

I don't think TX requires workman comp coverage, but I could be wrong.

Even if workers comp is not required, that doesn't mean it's a good idea to do without it. Anyone who is doing physical work around the property, including volunteers, should be covered by workers comp or equivalent insurance. It's why requiring contractors to be licensed and insured is considered to be "best practices".

I recommend talking to your insurance agent to make sure your HOA is fully protected. An uninsured injury can wipe out anything you save by not buying the proper coverage, especially if the injury involves a trip to the ER.

It sounds like your research of OSHA rules answered the question. If OSHA says fall protection is required at 6 feet and higher and 100 experts on HOATalk.com say otherwise, I would go with OSHA.
