i have a budget information question answered... In SC we have a non profit HOA, are we required to divulge bid sheets for out sourced work if requested by a home owner?

Check your documents to see what type of documents are available to homeowners upon request. Or ask your association attorney.

That ssid, if "bid sheets" is your term for a response to a request for proposal (RFP), I don't think a homeowner is entitled to see who bid what. Some of that information might be proprietary and it would not be a good thing at all for the association to disclose that to homeowners who don't have individual authority to say yes or no to any bid. That's what the board of directors is for.

You could show the homeowner the RFP that was sent to everyone who bid for the job and if the board has selected a vendor, a the homeowner could have a look at the signed contract. That's about all he or she is entitled to.

Furthermore, the SC nonprofit corporation act does not appear to list bids as records the corporation is required to retain and make available (on proper request) to owners. See Section 33-31-1602 at https://www.scstatehouse.gov/code/t33c031.php

You should check the appropriate HOA/COA statute as well.

Is this a condominium? Or a non-condo HOA? What year was it established?

Maybe the South Carolina regulars here can say more, but so far, I see nothing in the SC Condo Act that would oblige the COA to share the bids with owners.

My belief is owners are not entitled to see bids. They are entitled to see the final, signed contract.
