Our CAM (FL HOA) lied about proper notice of an annual meeting. Our CC&R's specifically provide the time frames required and they were late, very late. This was addressed during the meeting but the owner was shunned by the same CAM citing a FL statute. Even if we followed the FL statute, it was past the time. When the minutes of the meeting came out, no mention was made about being late and in fact the CAM wrote that the notice was proper. Myself and other owners feel of the CAM lies about this, what else could be taking place behind closed doors? Transparency is key and this CAM isn't showing any.

Per the Florida HOA statute, you could file a complaint about the annual meeting and election with the Florida DBPR. See details at http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0700-0799/0720/0720.html and search it for "dispute."

Chances are you would need an attorney to be successful.

Your property manager is supposed to be working at the board's - didn't you ask THEM why the meeting notice was late? If not, why not? That doesn't mean mistakes weren't made but before you say people lied, you may need to ask a few more questions.

If the manager screwed up, he/she should apologize, but your BOARD is responsible for looking at the calendar and factor in snail mail delivery especially now, because delivery all over the country is being slowed (partly because the dingbat the former president installed won't leave. Even though he didn't and still doesn't know Jack about the agency)
We've also had a few holidays starting in September and it would make sense to add an extra day or two.

Hiwever, if the board Did this to keep from being voted out because those homeowners weren't at the meeting (because they weren't told on purpose), John and like minded neighbors can and should work to vote them out next time or do a recall. Check your documents to see if they address recalls or special homeowner meetings where the issue can be discussed and a vote taken. If successful and you have a new set of board members they can decide if they want to continue with that company or hire another one.

I think Shelia is onto something. PMs take direction from the board. Perhaps it was the board that wanted the notice to be late to lessen voter turnout.

How many days late was the notice per FL statutes, Rob?
