What happens if the HOA DCCR construction minimum square footage is amended (increased) after I have bought my lot but prior to beginning construction? Which requirement will be valid when I begin building, the "old" requirement prior to the amendment or the "new" amended requirement?

Part of this may depend on who controls the community. It sounds like the community is still under developer control, meaning it controls everything (including amending the CCRs) u NH til the homeowners take over. Check your documents to see what they say - the amendment may apply to homes purchased after a certain date.

You may be OK if you bought your lot before the effective date. If you're still unsure, have your attorney take a look. You can also talk to the developer - if the amendment won't apply to you, get that in writing
