I have been dealing with a Developer BOD (there has not been a transition of the HOA to the home owners). Reading through several postings on new HOAs as suggested by some of the readers, I read with interest about BOD minutes. My question, when the BODs review financials, ACC reports, Delinquency reports, Violation reports presented by the PMC are these reports considered part of the minutes? I have always considered written material in front of the Board and noted on the agenda should be a part of the minutes, but our PMC advises that the ACC, Delinquency and Violation reports are confidential and not released. I did finally persuade them to provide the reports to me with identifying homeowner information removed - but I would like to see who and who is not supporting the HOA, violating the CC&Rs, and what architectual improvements are not being approved.

Tom, summaries of financials, ACC, delinquencies, and violations reports may be included as part of the minutes. Names of members involved should not be included. We cover this by a short statement in the minutes "The attached management report was discussed."

R, since Tom's association is still under developer control, would the same inclusions (as noted) occur in minutes of board meetings and those minutes to be distributed to association residents?
