I asked this question in another post in a bunch of other questions, but this one was never answered.

I think its pretty simple.

If a person holds a seat on the Board of directors and his position is NOT up for re-election in the current election cycle (i.e. until Jan 2009) and he wants to run for a different position on the Board that IS up in the current cycle (Jan 2008), should that member resign his position before accepting the nomination?

Please don't ask me to read my By-Laws or Covenants or State law, I'm very familiar with them and we have no provision. I have looked in RRO and I can't find anything yet, maybe someone has run across something like this already?

Chris, your post illustrates one reason to have the Board members elect officers rather than having officers elected by the members of the Association. I recommend changing your By-laws to have officers elected by the Board members.

Until that happens you would need to resign from the Board and run for the office you desire.

Our association does it this way. After the yearly election of Officers, they , the entire Board, new and old members, hold an "orginazational meeting," where they select and assign their positions on the Board. It is up to those who sit on the Board to decide who wants to do what. We do not elect a President or V.P or whatever. We elect a "Board of Director orDirectors. I have never seen documents that tell you who has to hold what position on the Board but that's not saying that there are some out there.

ChrisB4: A member is elected to a 'seat' on the Board by the community of residents. The Board only, as a collective group, decides who will assume what role/title. A Board position is not up for re-election or election; only a 'seat' can be up for election by residents.

It is certainly possible for Board members to change roles during their term of office--a role which may be better suited to their abilities or leadership/public speaking skills (or lack of) as in the role of President).
