Hi All. Our docs read: Each unit will have one parking space assigned to it. The Board of Directors shall designate such visitors parking spaces and such other reserved parking spaces as it deems necessary.

Here is the problem---everyone is assigned one space and the visitor's spaces are on a "first come, first taken" basis. (There are not enough visitor's spaces for every owner to have two cars.) Lately some owners have gotten "extra" cars. Some have three or four cars. Based on the above rule, the Board wants to limit the number of permanent vehicles to one per adult driver, per unit, not to exceed two vehicles. Do you think that can be done? We're a condo association. By the way, our attorney has told us in the past that if ever there are changes, no one can be "grandfathered" in.

The board should be able to pass a resolution for this new rule and it sounds reasonable. In our area, the county has always required the developer or builders to have at least 2.3 spaces (total) per residence in townhome areas and of course, that probably would have been fine back in 1957. If I had to guess, there is probably at least 3.5 cars per household right now and thank god there is a public street where the excess cars and trucks can park. I don't know how many total spaces you have, but it sounds pretty typical these days that you might wind up no having very many visitors. It's inevitable as real estate prices eventually go back up and density increases (drivers per household), that this will continue to be more of a problem and you all might have to go to a permit system. Under your proposed rules, how will you be able to enforce this without a permit system?

In the condo association where I own a unit, no one is allowed more that 2 vehicle entry cards and parking permits. Because some of these developements are older and have such limited space, assigned spots are a very special commodity and those who are older need easy access to their units.

They do provide an area near the center of the complex for excess registered cars to park. As this is stated in the ByLaws that "assigned parking shall be controlled by the BOD", to change it and allow extra spaces, does not require a membership vote.

But in your case, your Docs read "Each unit will have one assigned parking space assigned to it" means that you will have to have an amendment change proposed and go before the membership for a vote to allow assigning of a reserved extra space. I can imagine during "SEASON", that it must become a free for all to get a parking space.
