I'm on the Board of my association. One of the units has a gazebo in their backyard. The gazebo has termite problems. Assuming that the maintenance/repair of the gazebo falls under the responsibility of the owner, can we force the owner to remove the gazebo? Or is it better to offer the owner the option of either paying for termite treatment or removing the gazebo?

Given this incident, I think it might be wise for us to schedule yearly termite inspections (including the inspection of everyone's backyards). If any of the members refuse to participate, what would be the best recourse? Can we fine them until the inspection is done? Is there a limit to the fine we can impose?

If you don't think the owner knows, then I would stop by and talk to him.
If he/she does know but loves termites, when it collapses wouldn't it become an
eye sore??? thus comments from the PM. or BOD? Sounds too Gestapo for me.

Townhomes. His unit is right next to my unit and we share a wall and fence (uggh) so I'm worried about the problem spreading to my unit as well.

Then I am sure your CCR's have a provision about termites and who is responsible, and that would be the HOA paying a termite contract on all units, since they are on the outside. Therefore the gazebo would fall under the realm of the HOA board being able to ask that he pay to treat it or remove it.

I would be concerned, I have seen the damges that termites can do when go untreated.
