our association have no knowledge of the calif laws that we
understand are in effect. we do not send notices of annual
meetings nor proxys etc. where can we obtain this inrormation?

Do you have a set of documents that you recieved when you bought into your home? That is where to start. We call them C.C.& R.s and they are also known as "Protective Covenants, Articles of Incorporation and ByLaws. Those should spell out how your association is to function as a Home Owners Association. The Sterling Act is what the State of Cal. has for controlling H.O.A.s but your own documents should spell out what you need to know.

Do you have a management company? They should be aware of the Davis-Sterling Act. If not, do a google for Davis-Sterling Act and curl up with it. Harold

I thought the new "rules" went into effect Jan. '08.....in CA.

The new "agenda" law goes into effect Jan.1. There is a entire civil code dedicated to homeowner associations, condo associations, etc. along with a business, corporation and vehicle codes.

Start with the Davis-Stirling Act. That will cover most of your questions.

I would advise you to start following the laws immediately. If some homeowner gets wind of the fact you aren't following the law, you could see yourself in court and very well lose.
