My Condo Association is ordering everyone to use Surepay. I prefer to handle my payments. I do not want to give authorization to anyone to automatically take money from my bank account. Can they legally do this? I am in a senior developement in AZ.

LindaH4: I don't believe they can force you to use one payment procedure over another (unless your documents state such) as long as payments are made.

I do know that banks charge a fee to the assn. for withdrawing from the accounts, and it may be cost effective for the assn. for all residents to use the process.

Do you think it may be a problem of residents not sending in payment/s on time and this way they are assured of payments recd promptly?

By what authority are they doing this? What happens if you don't? Ours offers it and "encourages" it, but no way demands it. I would definitely challenge them on this. Wouldn't it be nice for all creditors out there to be able to demand surepay. Harold
