I live in a HOA in Ca.
My home is right in front of the gate were there is a tire shrederfor one access.
the noise is on bearble what can i do?

yes but recently replaced with new one that is much louder

Is this a shredder used in a business next door to your home or something your neighbor uses - a lot? Did you ever discuss the racket with our neighbor (or business) when you moved in? If not, I can see what he may have assumed getting another machine wouldn't bother you. Or he just didn't care.

You didn't say why you think this is an association issue - right now, this sounds like a dispute between neighbirs, so you'll have to go over there and talk to the owner and see if you can agree on a solution. If he runs it 24/7, you may be able to get him to reduce the hours. Or not start early on the morning or quit in the evening.

If you have other neighbors, talk to them to see if they're annoyed and all of you could talk to him. That may be when the HOA might be able to help because several people are involved. If that doesn't, see what your documents say about nuisances. Homeowners can enforce CCRs against each other, so this may end up in small claims court. He sure to document what th do and when.

Yes, that will also include a time and date stamped recording (maybe several) of the racket. Perhaps you'll need to consult a sound engineer who can listen and maybe measure the decibel level. That could show if this is harmful to your hearing and peace of mind.

In my opinion, all you can do is:

-- Document how bad the noise is. You may need a professional acoustic expert.

-- Ask the board nicely to get a different tire shredder.

-- Hire an attorney and ask if you have a leg to stand on, legally, using the covenants that speak of nuisances and excessive noise.

I would speak to the board and/or manager and see if they are willing to do something to reduce or mitigate the noise. Something as simple as a barrier between it and your house may make a big difference. You might also check your local noise ordinance. If the tire shredder violates the noise ordinance that is an easy fix.

Who owns the shredder? Is the shredder on Association property? What is the cities noise ordinance? Is the shredder causing any air quality issues?

I think the OP is referring to spikes that prevent cars from entering through the exit.
