Our ARC has established guidelines for fences that they must be white, vinyl, three rail split rail fences. In essence, everybody's fences are identical. Our Declarations are not nearly as specific; they simply state fences must be "split rail." Honestly, nobody has objected to this. However, I often read on this forum that rules and regulations must be consistent with the covenants. So I'm curious if this additional specication would be considered consistent with our Declarations. Thoughts?
(b) Fences. Boundary Line Hedge and Shrubbery.
No perimeter boundary fences are permitted other than (i) a buried electric fence and (ii) with respect to Lots improved
or to be improved with detached single family homes only, split rail fences that do not extend
forward of the rear building line of the dwelling, do not impede or interfere with the proper
drainage of any drainage swales or other drainage or storm water related facilities, and are not
more than four feet (4') in height or such lower maximum height, if any, permitted under the
applicable codes or ordinances of the Town of xxxx; after obtaining prior written
approval of the Architectural Board.
