One of our board members submitted an architectural request several months ago to install a light pole in his front yard. We voted NOT to approve the request as we basically do not allow anything in the front yards of our townhomes. Around the same time as his request, we began updating our landscape/yard rules/regs and he submitted that pole lights be included in the regs as something that is allowed. The draft regs have not been submitted to the community yet for approval and are still basically in draft stage.

This past weekend he installed the pole light in his front yard. Last evening we had our monthly board meeting. It was not mentioned at the meeting. Frankly, I am astounded that a board member would do this in direct contradiction of a board ruling.

My question is: What do we do with this board member who has blatantly disregarded a decision of the Board?!

Sharon, send him a notice of violation letter. Advise that the pole light must be removed since his request was turned down. All members must be treated equally. We have sited President's and other Board member many times.

Thank you -- I was thinking maybe he should be removed from the Board. I think as Board Members we should hold ourselves to a higher standard and set an example for our community. To me, he laughed in our face. Maybe I am overreacting. Thanks again!

Over reacting? I doubt it. A board member of all people should lead by example. Otherwise, how then would they have the gall to sit in judgment of others and expect others to obey the rules? I think he should be removed from the board if he refuses to remove the pole. Then he is no longer a member in good standing and doesn't belong on the board. Harold

Yes, send him a non compliance letter just as you would to anyone who had broken a rule. Give him 30 days or whatever your Docs might require, to remove it. YOU CANNOT GO BY THE NEW GUIDELINES AS THEY HAVE NOT BEEN PASSED AND ADOPTED SO DON'T LET HIM TRY THAT STORY.
