BOD R&R No Record

We have a potential issue. It has always been accepted that the BOD made a rule banning overnight street parking when we owners took over some 6 year ago. Over the years there have been some told they are violating the overnight street parking ban and they complied.

Issue is we have no written record of such a R&R (sloppy record keeping) and we are expecting someone to challenge us.

Your thoughts.

As you know, John, if it's not in writing or at least memorialized in your meeting minutes, it's not a rule.

So go ahead and make one. Do owners in general like the unwritten rule?

It could be in some meeting notes which may suffice as a "rule" in some situations. However, in order to make it an official rule, I would follow the correct procedures in putting it in your CC&R's and filing them. A long timely a little expensive project. However, it may be time to update other things as well.
