We have a potential issue. It has always been accepted that the BOD made a rule banning overnight street parking when we owners took over some 6 year ago. Over the years there have been some told they are violating the overnight street parking ban and they complied.

Issue is we have no written record of such a R&R (sloppy record keeping) and we are expecting someone to challenge us.

Your thoughts.

Yes our owners like the rule but we have received and complaint by one owner against the other. I think the violator may push back but we are sending them a letter saying there is no overnight parking. We will see what happens.

It could be in some meeting notes which may suffice as a "rule" in some situations. However, in order to make it an official rule, I would follow the correct procedures in putting it in your CC&R's and filing them. A long timely a little expensive project. However, it may be time to update other things as well.

Depending on John's CC&Rs, which may give the board the authority to make parking rules, there probably is no need to amend the CC&Rs.
