our clubhouse closes at 4:30pm. In order use the club house after this time a fob must be purchase for a fee. Is this discremination for those
who cannot affort or due not purchase by choice, The clubhouse should be aavailble to all on an equal basis. your opinion is appreated.

Are you a retirement community or working families with kids? What is the charge for this "fob?" And what does that entitle you to do with it? What facilities are there? Do they require a live body be there when open to monitor, etc?
4:30 seems awful early to close your clubhouse. Did they allow the members any input as to what your hours would be in YOUR clubhouse? Need lots more information. Harold

The HOA has the right to charge reasonable fees for the clubhouse. Many HOA's charge fee's for security (incase someone damages something), rental fee, cleaning fee, or in your case an FOB fee. IMHO this is not unreasonable.

I have heard and seen a lot of documents that allow for the BOD directors to charge fees for use of common property. In condos especially, there may be storage areas over and above those designated limited common property (a parking space and a storage area). Extra storage rooms can be rented out on a first on the list bases, we even built extra golf carts shed to rent out. Some places have areas for rv and boat storage, any time a business (association) can fairly generate cash, they should do it.
In fact it is a good idea for the members to explore new ways of raising cash.

I think a reasonable fee would be 75 FOB, unless it should be reasonable to charge 50 FOB. But maybe in some instances 150 FOB might not be enough.

I don't know what a FOB is nor do I have any idea what is a reasonable fee.
We charge $100.00 plus cleaning fee, but how reasonable that is remains a mystery. We have been charging that fee for 10 years. Funny when you mention that. Our fees can be raised the CPI for our area, and they do it every year, but other fees stay the same forever. I think I will bring that up at annual meeting or maybe send an e-mail. Thanks.

our monthly assesment alows for use of the clubhouse.
is it right to pay more to use the club house after hours?.
this is a one time fee. no chare for utilties or cleaing.
only for residents, no parties or rent.

FrankD2, as you posted (and this is not spliting hairs), the use is "after-hours." Granted that this is not a juke-joint "after-hours" (for those of use old enough to remember them, I have seen "pictures" at the Smithsonian - smile), it is still "after" the normal management function for the community has left for the day. There is always the concern for the general care of a common element - it is supposed to be there for everyone's use. I think that you can open up a facility "after-hours" if the HOA agrees (hence budgets) to absorb whatever is necessary (cleaning costs, key-fobs, altering the security lock-out times, additional general/liability insurance, etc) to make this happen. I also believe that this is an item that should be properly announced in the medium of communication used by your community - so that it isn't a knowledgeable fee who can take advantage of the additional hours of the element.

Thanks Frank.. I knew a FOB was a locking system but how it was used above threw me off.. In our case, it would be simply... the key system.
