Our development is in deep trouble with this new coo board that took over. We need a good lawyer

Isabella, Depending where you are located, many attorneys specialize in H.O.As. Check your yellow pages and call the local Bar Association.
But I question you by your post, that you need a good lawyer because of a new Board and the "Coo"? Rather than spend association money so fast, what can you tell us about your situation? There might be a simpler solution for you.

The new Coo board when they got into office October 2007 immediately assessed us $500.00 each unit. Now they want to take out a loan for over 30,000.00 dollars at a bank and assess each unit to pay for this loan. The loan is to rebuild what the hurricane torn down. We were still waiting for the insurance Co. to pay up. But you know how that is. The new board said" If we don't like it we can move". Isen't that such a caring way to to address the home owners !!!!!!! There are so many things that they are doing I could fill a laundry list. I think if we could speek to a good lawyer, it might help us to understand how they can take out this loan with out our approval. We are a over 55 housing area.

What is the required approval process for a special assessment that is specified in your controlling documents? If the Board has total authority rather than a vote of the Association members, I don't see how hiring an attorney would be beneficial.

Do you know the current status of insurance payment? What portion of the damage repair will it cover? If reimbursement will cover the repair expenses then I suggest an HOA loan may be a better solution than a special assessment. One purpose of hiring an attorney might be to speed up insurance payment.

Isabella, is this a condo? You might want to read Florida Statute 718. I am familiar with 720 which tends to follow 718 by a few years and it requires quite a bit to get the approval for a special assessment.
