Does anyone know of any legislature (state or federal) orlegal document that deals with rights to live peacefully in a condo dwelling? I recently purchased a condo on the third floor of an apartment-style condo complex. The unit was a foreclosure and I believe the lady that lives below me has become quite accustomed to no one living above her. In response to my walking around the unit, she bangs on her ceiling as if to say I am being too loud. I obviously have a right to live in the unit in a manner that is reasonable. She has written me letters about being too loud and has now complained to the property management company, who has also written me a letter. At the end of the day, she appears to be a bit ornery and has unreasonable expectations. It is my hope to attend a board meeting to discuss this matter and I would like to support any rebuttal they might have with some form of legal doctrine. Thanks in advance!

Perhaps when you, the board and your neighbor comes to a mediation meeting you can bring about a resolution to make all parties happy.

I think what Gloria is getting at is: The support you need to take to the mediation meeting is a common sense approach. Most of the times these problem can be negoiated. One thing you might want to find out about is if this person complained about the last tenants, or does she complain about everything, which really should have nothing to do with your problem, but it may be an indication there is really no problem.

It can be a real problem and pit neighbor against neighbor and I would first try to see what she is expecting from you.

I'm not siding with your neighbor here, but living down below units (IMO)really is the pits. We had a condo (built in 1989) with W/W carpeting and it's been brutal. I had one neighbor that used to like to vacumm at 3am, another was very heavy and walked like a Nazi Stormtrooiper, another had a young child that used to like to run at night after 10 pm from one end to the other of the condo (back and forth) all night, and another had a large dog and used to run back and forth late at night. Some older condos, simply have no sound attenuation between floors, some have all Wall to Wall carpet, some have just hardwood floors throughout, some have wood sub floors and others may have concrete and some might have a sound deadner called Gypcrete. Never again, will we live under another home. Maybe it's time for some area rugs and face to face mediation.

Kevin, can you just imagine trying to bang on YOUR ceiling all the time?? She must be a gymnast. It really is too bad this woman doesn't take that energy and channel it elsewhere. However, I suggest you try a knock on her door, and kill her with kindness. Honest. Sometimes the simplest solution works. Many times that is all these complainers need, which is to be listened to. Just a thought, and keep reminding yourself what a good deal you got on the purchase of your foreclosure....maybe she ran the other owner off.....!!

When you live in a condo or apartment where there is someone living above you, it's called a permissible nuisance. Unless there were construction conveniences such as soundproofing people have to live with whatever is above them.

Reminds me of when we were first married and moved into a ground floor pool side apartment. Lived there over a year and just loved it. Suddenly someone moved in above us. The kitchen was located over our bedroom and the lady wore heeled slippers and walked back and forth, back and forth. When we complained to the mgr, we were told that we had been spoiled because that appartement had been vacant and used as a storage area until recently. It wasn't too long before she moved out. Whew. BUT then "actors" moved in. They came home at 2 or 3 am from "work" and brought friends. That's when we went out and bought our first house with no one living over top of us. LOL. Never again.
