Hello all,
I am new to the forum and hopinig someone can steer me in the right direction.

I did serve on our HOA for several years and honestly I am a bit concerned. The building that I have lived in for the past 6 years has had the same HOA President in place.

#1 This isn't the norm I know. How do I go about getting this changed?

Sorry I didn't specify that this is in California. and the current president had consecutively served for 7 years. Our ballots go out and her name is the only candidate. How do I go about changing this? I already asked the management company for guidelines and there essentially never responded.

The MC works for the Board, tells you something. If the current president has served for 7 years with no opposition that also tells you you don't have anyone watching the store. Where are the other Board members, the president has to be elceted by the board, each year.

You change this by getting involved and getting other members involved. Talk to Board members and see where they stand, ask if they voted her in?
Your answers will come 99% from your documents, you will need to study them. As far as the president for seven years goes, if she gets elected she can serve for ever, and maybe do a great job. But not likely, you need change and vitality in your association and that only comes from different people helping and doing things, the first thing is concern by all.

Thank you. NO the President has elected herself by just assuming the position. She hasn't had any open opposition as our home owners are lazy. No. she isn't doing a good job and as board members are elected on she just keeps maintaining her self as president.

This is obviously going to change.

NoelleC, not to make "light" of your situation (it is a bad one as you have described); however, the Prez can ONLY do what the other board-members allow her to do. So I am not sure how much you can "change" with just replacing her. You did not list the number of board-members on the current board - and as posters have noted, the board is elected; and then elects officers among themselves in most circumstances. Therefore, the Prez for Life, must have had the support of the other board-members to have served for that long of a period. You may want to look to some other "lazy" owners for their involvement in the board activities, so that you walk/elect in with some ground support - otherwise your single vote may not be enough to effect change on the board (depends on the numbers).

A stir is good and maybe some more stirs. A boil is bad, so is a simmer.
Keep good files on what you say and what you do. Nothing wrong with a "Town meeting" at this point and if you lead the meeting your job should be make sure you keep the lid on the meeting, don't let it get out of control, and try to appoint or ask different people to do different tasks. Like visit to court house to review your documents, all of them. Visits to county zoning to see what they have, visit to BBB to check out your MC, have folks do a lot of research on the web for state and county laws about HOA's, (legal) stuff. Be prepared to face a challenge from the floor by your current Board or supporters. Not everyone will appreciate what you are doing and if you do a good job, don't expect any monuments or even much thanks. In that regard it is much like being a good board member.
