Hello. I am on the Board of Directors for our homeowners association and we have a covenants that was handed down to us from the developer. We can not get a quorom at our annual association meetings so we are positive that we can not get a quorom to vote on a new covenants or for any amendments to the old covenants. Is there any other way about doing this? Some type of loop hole maybe?

Brain, you will need to vote by mail-in ballot. Use the search to find many discussions on amending Covenants.

As Roger said, you should do the mail in ballots. Also you can use proxies if your Documents allow their use. I went door to door, gathering a handful of proxies to get amendments passed. It depends how hard you want to work. It is a sad state of affairs that owners do not want to get more involved because it is their voices that make things run according to the wishes of the entire membership.

Brian,
Please give us some information about your association. How many members do you have (units or owners) How many Board members are there according to your documents? You want to have amendments to your CC&Rs? There is a process that you will have to do to make any changes to your CC&Rs and going door to door is either to get your residents interested or to get proxies signed if they are allowed to count as votes. But it sounds like you are a long way from changing things. You need Board and owner interest to do so.
