The Board recently found out that a particular house is not owned by the current resident, but the resident is the cousin of the owner. We don't know if this resident pays a fee or "rents" the home from the legal owner. Because the resident is not the owner, could this person be considered a renter, even if they are a family member?

They are not an owner so thus not a HOA member. So whether or not they "rent" or not is irrelevant. The HOA goes after the member/owner. That person then goes to their resident whom lives there.

If we find that a owner is using an offsite mailing address, we will send them a form to update the current resident's information for emergency purposes. Some HOA's CCRs and/or Rules might require a copy of the signed lease as a condition.

Considered a renter for what purpose? Do you have rental limits or restrictions?

Relative or not, if both parties claim that resident is just a guest and not paying rent, it could be hard to prove otherwise, and trying to apply rental restrictions may not be on sound legal footing.
