I live in a gated community in Florida. A little more than a year ago Sun Community bought our community. Anyway, we have a front gate with a security guard during the day, and after 8pm we need to use the code to enter. From the road by the guardhouse all along the main road we've always had trees and brush to prevent outsiders from entering our park. The new owners have decided to get rid of the trees and brush, and to install more manufactured homes....but not put up any type of fence separating us from people who live outside the community. When asked, the park manager said that we are really not a gated community and that a gated community means that there is a gate so cars can not get in. Is there any statues or laws pertaining to what a gated community actually is? This is a 55+ community and all bought here for the feeling of being secured.

You say the trees/bushes, etc. were always there so can we assume that "section" was always part of your community, just not developed?

Can you define what does it mean "Sun" bought your community? What types development are you? It sounds like a land lease where you own the "home" but it sits on land you "lease" such as in a mobile home park?

As far as the gate it concerned, it sounds like it was a "feature/amenity" that Sun is removing. Where is it said that it would always be a gated community?

It seems you are at the mercy of "Sun". Sorry to say but quite common when "buyers" do not understand the type/structure of a community they are buying into.

Yes trees and bushes were always there. We own the manufactured houses, but lease the lots. They advertise this as a gated community. Anyway, the previous owners sold the property to sun community, and they are now our landlords. Our prospectus says that we have a security gate. But what use is a gate without some type of fence or barrier?

Do you really think the trees/bushes were stopping people from entering your neighborhood? To me a gated community does not mean/indicate a fenced/walled in community. I have not been in all gated communities but I can say I do not remember any I have been in that were fenced/walled in.

Gated community usually means you have a gate of which cars are limited entrance. It doesn't usually mean a fence around the whole community. Just where cars can enter.
