Good morning, our board of directors and property manager have posted a notice that reads as follows:

Private and Confidential Legal Meeting Notice is here by given that the Board of Directors will conduct a confidential.and legal meeting with the association attorney regarding violations and their potential enforcement thru legal means.
This is a private meeting among the board of directors and legal counsel due to attorney-client Confidentially privileges.

Here is my question: can we request what violations they are trying to enforce without revealing any names and addresses of violators? Are we entitle to a copy of items that were discussed?
The other issue is that they are claiming that notice of this meeting was posted on Thursday April 15th 2021 which is false.
Thanks you.

I believe you have indicated in the past that your HOA is subject to FS 720. The HOA only has to provide those records given in FS 720 and the FS 617. In my opinion an Owner is not within his or her rights to request some kind of compilation of what the HOA is trying to enforce. Why? For one, this is not a record under FS 720 and FS 617. It is something the Owner is asking the HOA to create just because the Owner made this request.

I would advise the Board against providing anything like Minutes for an Executive Session.

I cannot see value in fighting a battle over the date of the posting of an executive session.
