DBPR has placed 5k fine for not having financials
available after request/late on financials not filed/
over three times. Has uses funds for an assessment
to pay other bills and refuses to discuss as to why
HOA does not have a two three choice of auditors they
use one not sure how they got job.
So who pays for the 5k fines Management or HOA
we are sure more will be coming .

The board is ultimately responsible for running the HOA, the MC's role is to assist the board in doing the grunt work. If the board was asleep at the wheel, hopefully they will learn a lesson.

If the HOA is getting fined, the HOA pays.

Agree with Doug.

This would be an HOA responsibility.

The HOA could go after the MC to try and recoup, but if it were me, I would simply want the MC to go away so they don't cost the Association any more money.

Unfortunately, the HOA must cover the fines because it is ultimately the board's responsibility to care for finances. If management is not doing their job well, then it's time for the association to start looking at other options.

It's Florida’s state department of business and professional regulation. Its division of Florida condominiums, timeshares and mobile homes handles complaints involving the same. Since you’re in Washington, they can’t help you unless you have a condo, timeshare, or mobile home in Florida. You may want to contact the state attorney general’s office in your state to see if they handle complaints involving HOAs if that’s what you want to do.

PS to Rob – paragraphs and periods (and commas) are your friends – please use them. I concur with Dough, Marshall, and Tim as to what you and your neighbors will have to do regarding your board and its oversight of the property manager. Rally together and vote them out in the next board election or check your documents to see how special meetings are called. You may need one if you want to recall the current board, but be sure you have people ready to step up and take over (one may need to be YOU). You may not be able to stop the fines, but the new board can review how this came about and take steps to ensure it doesn't happen again.

You are correct they are my friends , just livid
at the fact that this board is worthless and they
keep getting voted in.
We are a 55 plus community and most of us are in our 70's
plus and feel they ( HOA& MC) take advantage of that fact.
Last President spent 18k on tree trimming when trees belong
to city, no emergency to simply just trim.
This new President has given Xmas bonuses to MC personnel
when we have no funds.
Appreciate your responds, hopefully we get enough people to
simply contact State.
