We are looking for a sample Special member meeting petition and instructions to prepare that meets Virginia HOA laws. Any help would be appreciated.

We have reviewed that template and find it very helpful but are unsure if the same rules apply in VA. We are unable to find any info from VA law with regard to format of the petition. They do have rules about having a special meetings but not petitioner format. Thoughts? Thanks for any help )

Typically the reason for a Special Meeting call must be clearly defined. Such as recall Jane Smith from the BOD and replace with Bob Jones. Recall A B C D form the BOD and replace with E F G H. Strike down a BOD Rule concerning Pool Hours, etc. It cannot be a general bytching session such as discuss BOD Performance.

Also any % in the Bylaws, Covenants, etc about change such as so and so % OF ALL OWNERS approving stays the same. It does not become so and so % of those attending the Special Meeting approval. If it is 2/3rds OF ALL OWNERS approving a Covenant change that stays the same. It does not become 2/3rds of just those attending the Special Meeting approval.

Recalls are especially difficult to accomplish as they can be easily legally hung up. If looking to recall people(s), it is best to work to not vote them in again come Annual Election.
