Our HOA is having a board meeting coming up. I just got a letter in the mail that showed the names of the new people to vote for. We use to have all the developers as the board but now we can switch to homeowners. I only seen one homeowners name on the ballot. Then the three others is a homeowner but works for the developers and the two others also work for the developer but don’t own a home. I didn’t get any information about it coming up. They said they sent an email but many of us have not had any notification for meetings or etc. So I asked if I could still go on the ballot since it’s not for another month but the hoa representative said it’s to late since the mailing is out. Then I asked why are there three developers still running and only one developer employee is a homeowner? They said since only one homeowner sent in the request to be on the ballet so they need three positions to fill. I read later on the letter did state that someone could be in the ballot if they are nominated at the meeting day. My question is, should I see about the nomination on the meeting day and wouldn’t it be easier to just add me since the meeting is weeks away? Hope it make sense so will show below how the ballot looks.

Homeowner A (running)
Homeowner B/developer employee(now on board/running again)
Developer 1/not homeowner(on board now/running again)
Developer 2/not homeowner (on board now/running again)

And me, who wants to run but was to late signing up. I am a homeowner

Sue, our Board of Directors election is handled at our Annual meeting. One of the election steps is to ask for candidates from the floor during this meeting. This is a way for people like you to get on the ballot.

If Nominations From the Floor are allowed, nominate yourself at the Annual Meeting. Also gather some Proxies and vote them as you wish. They may help you get elected.

You say owners can be on the BOD but is the association still developer/declarant run?

Has control of your Association been turned over to the Association by the developer?

It is very common in a new development for an association member or members to be eligible for a position on the board of directors when certain build-out percentages are reached. One association member at 50%, two at 75%, etc. If it has been turned over, there should be none, or perhaps one, non association member developer representative on the ballot.

The fact one of the persons running is employed by the developer is not germane, they are first an owner and therefore are eligible to serve on the Board. There may be conflicts of interest which would require that person to recuse in some situations.

I suggest you read closely the Bylaws of your Association to determine the process for nomination and election of directors at the Annual Meeting of the Association.
