What is the liability of a dog park in Virginia? Also, what is the liability to an HOA for the dog park.

You will need to check the state laws for yourself as each state may be slightly different.

Here in NC, I called my local government as it manages public dog parks. It turns out that pets, in NC, are considered property of the owner so the liability is with the owner. Our HOA controlled dog park required signage approved by the local government but incurred no additional property liability, insurance-wise, as a result.

I think you should check with your insurer to see if a dog park will result in additional premiums.

Unfortunately, just about anything can incur potential liability, but until someone sues and a judge rules, it might be hard to determine how much of a potential liability.

It will be a liability question. Start with the associations insurance agency. It will alos be a cost item as in making such and keeping it clean and in good working order.

Bottom line is I expect non-dog owners are not going to want any it to cost them any money either directly or indirectly.
