We have this notice that businesses have to put up in Georgia to reduce liability. Is there a way that this could apply to the pool and other amenities so that we can reopen our pool, etc? I don't see how this would be different than a bank having an ATM open for use. Should the bank have to go through extra sanitization procedures to reduce risk or have special insurance should someone claim they get Covid from the keyboard of the ATM?

That's a legal question that's best addressed by your association attorney and perhaps your association master insurance. A notice like this is likely intended for public places like a gym, but HOA amenities like a pool of fitness center aren't necessarily public, as they are intended for use by residents, whose assessments help pay for them.

This is why I personally believe amenities should remain closed until the COVID numbers in your area are way down, and even then social distancing, masks and all that will still be necessary. Just because vaccines are coming out doesn't mean everything will go back to normal in an instant. In fact we are now in a new normal and that's still evolving so we don't know what that will look like.

If your homeowners are clamoring for the pool and what not to be reopened, check your county health department to see what's required, such as limiting the number of users to 25% of the capacity. Get some numbers to see how much sanitizing equipment and supplies would cost along with the labor costs of someone (or several) to monitor the numbers and spray after everyone.

Determine the cost per homeowner and then tell everyone if the pool, clubhouse, etc. are reopened, this will be the surcharge. You can decide if this will be per use or a monthly fee whether people use it or not. If the homeowners don't mind, have your attorney draft a waiver for everyone to sign, get the supplies, hire the attends and have at it.

Will add that I will NOT be going into a swimming pool for awhile. It's got to be pool of disease potential. I mean how many times you go under water and it goes up your nose? That is where Covid lives...

The chlorine in swimming pool water kills the SARS-CoV-2 virus pretty easily. In fact, swimming in chlorinated water is one of the safest things you can do. If it goes up your nose, all the better.

We are going to wait and see what the Health District proposes, our Governor is supposes to give another edict on 2-15 so we shall see.

I still won't forget my cryptosporidium infection from a public pool or the eye infections... Look up crptrosporidium and say again how safe water is... They don't die in chlorine for 3 day... not everything is killed by chlorine...

My expectation is our community will operate our outdoor pool more normally in 2021 than in 2020. We may encourage the bleach cleaning of the deck chairs and social distancing by our guests but public education and understanding of COVID is much better in 2021 than last summer when fear was abundant.
