Ive recently become president of our board as no one else wanted the job. We have a new board member that is a problem. Whenever he wants something and the board decides against it, he goes and rallies homeowners to "get them on his side" so that they demand that the board do XYZ. I haven't seen it with my own eyes, but people tell me he does this. The most recent example is trash collection for the community. Our Bylaws don't have a utility clause. And, I did a very detailed breakdown for the board on how we cant afford it; it will literally put the HOA in the red. At that point every board member but him decided to not move forward with trash collection. So, he riled up a bunch of residents so that they would be irritated and angry with the board at the meeting for not having trash collection. He has suggested to residents that the HOA should use reserve funds for this. This CANNOT be done--the HOA would be in big trouble. He's a board member--he should know this. He did the same thing with a community clubhouse to be built by the developer. We ended up having to sue the developer over this--long story--but he thinks we shouldn't. So, he again roams the neighborhood mischaracterizing things, gets homeowners stirred up, they get irritated with us thinking we're in a frivolous lawsuit, (It Isn't)and the cycle continues. This generates hostility and distrust of the board.

I can go on & on, but it's so bad that two good board members want to quit because he has zero decorum/critical thinking skills/foresight. He sabotages board efforts being a troublemaking buffoon when he doesn't get his way. I'm at a loss on how to handle this guy. Any suggestions?

Yep - those folks are out there - and, legally elected by the membership.

Run your Board meeting tight - don't allow aggressive discussion to occur - and limit this person's ability to effect the actions of the Board. However, they were elected and have a right to be a contributing director, so ask them to do a study on the garbage situation - making sure you mention that an increase in assessments is probably appropriate, if the community wants common trash pick up.

Thanks George, great points. I actually DID do this. I told him that perhaps I overlooked something in the financials that would allow trash pickup to come to fruition. I didn't. I said this so that he'd see for HIMSELF we cant afford it. He chose to go get homeowners riled up instead. How can I effectively limit his ability to affect Board actions?

Short answer is - you can't - except to offer better ideas. You can also maneuver by asking him to work the issue and provide specifics - and with another member of the board. If he refuses to work the issue, just shrug and move on.

Do his motions pass when they are counter to your position? If so, you are in the minority - and will need to better prove your position and work the other directors.

Work the numbers, ensure you are accurate, quote chapter and verse on why reserves can't be used, know MD statute, and make him work harder.

And, if the community wants trash pick up included, offer to work to do so and raise the assessment to pay for it - but, there may be issues there, as well - unless you CCRs allow you to control utilities.

Ah gotcha, thanks George. No, his motions never pass. They are almost always nonsensical. He suggested that we insist on our landscaper use the public fire hydrant to water plants/grass in the common area. I don't even know if ignorant is the best word...
