Hello
I live in a community that has 1 master association and three sub-associations. I would like to know which board would vote on certain rules.. Let's say the homeowners want to be allowed to have privacy screens on the balcony would this be voted on by the master association board or each sub associations.

Master Association Rules and Regulations will outrank the sub association. They will be more general in nature while the sub association will be specific to that association, specially as it pertain to architectural issues.

You will find the answer in, most likely, the Declaration of the Master and Sub-Associations. There is no hard and fast rule which is applied universally.

For example: we reside in a 105 single family home Sub-Association of a Master association with over 9,000 homes. Our Sub-Association Declaration contains no architectural or compliance language, everything defers to the architectural and compliance guidelines, and rules, of the Master Association. WE exist as a Sub-Association as this was a gated community at one time, although the gates were removed over 10 years ago we remain an incorporated Sub-Association due to other stipulations in our Declaration.

While it is best to read the documents of both the Master and Sub-Associations, it can be tedious to do so. You may find the property manager for your Sub-Association can assist you, or you may contact the Master Association with your question.

The post from JohnC77 proves my point--and his. One must review the Declaration and Rules for both to determine which organization controls when discussing architectural standards or other matters.

Especially true if each sub-section is architecturally different. If identical structures, I say the Master Association rules.

There is a master association in Southern California that has over 3600 homes with 10 different subs. There are nine different management companies and the management company managing the master does none of the subs. All the enforcement is done through the subs.

The problem is the rules and regulation is basically a cut and paste from the master to each of the subs. It is word for word the same just a different home picture on the first page
