Our Clubhouse is still closed due to covid. However the manager still works there and brings her child to work and has been seen going in with visitors. The board claims it can't be opened due to liabilty. How long can they keep it closed while we are paying for it in our very high HOA dues. $394 per month by 500 owners.

Why don't you ask the Board when they plan to reopen the Clubhouse and under what guidelines for use?

What are the state and local rules regarding the size of groups which may assemble? The manager and her child clearly are not increasing the risk to themselves by entering the clubhouse, or to any of the owners. Is her office located in the building? The visitors may be those who are meeting with her on association business and number less than the meeting size guidelines.

Remember too, some of the costs of the clubhouse are not diminished when it is not being used. Granted, there may be lower cleaning and utility expenses but the building itself and its components continue to age regardless of use. If the clubhouse is taxed or has an alarm system, those expenses continue.

Perhaps as long as you and others do not step up to replace the board either through a recall or the next annual election.

They can keep it closed as long as they see fit in terms of accommodating group rentals due to best practices associated w/ COVID-19 abatement, which is much different from a property manager and her child coming into the office. Come on.

I agree with everything said here. If you've been paying after to the news you know COVID is a long way from going away and the numbers keep going up because people will not follow social distancing guidelines.

We have a clubhouse and haven't been able to use it either. There hasn't been a lot of fusss because people would rather be safe than in the hospital on a vent or stacked up in a funeral home or morgue refrigerated truck because the morgue is full. That's life dude - You don't always get what you want.

You want to use the clubhouse, educate your on the county or city guidelines, figure out how the association can make it available and reduce the risk of being sued if someone comes up positive, and keep the place sanitized - and how to pay for it all. Take that information to the board and see what they say.

As for the kid, was that a one time thing or does this happen all the time? You don't know what her circumstances are, so before you start accusing someone of misconduct, maybe you should ask. I doubt the kid's funny by around playing on the fitness center equipment or splashing about in the swimming pool.

The Board could (I believe should) keep the clubhouse closed - and, I would suggest the Board also prohibit anyone other than the onsite manager (her child is part of her group).

Visitors is another thing, entirely. If you mean visitors from the community, I am assuming they can do business by phone and email/text. If you are talking folks not part of the community being managed visiting the manager, I would say no - unless, again, they are part of the manager's family group.

The point is to both assist in preventing the spread of COVID, and to protect the association from liabilities.

When can it be reopened? I'm thinking when the government decides we have met herd immunity standards.
