The HOA in NC where I fortunately sold a condo has not yet removed me from its community-wide email group. As I previously posted, the property manager was on the board and was sued for fraud, with allegations that the property manager was taking HOA funds.

Now owners in the HOA and the property manager are fighting with each other, via emails sent to the whole community.

The owners are accusing the property manager of all sorts of bad acts and being a bad person generally, and the property manager is accusing owners of being ungrateful for all of his work.

I'm out of this community, but for future ones, I assume that the HOA wouldn't want a HOA-run email list used for false statements because an HOA could be liable for statements made on its email list, right? Thus it's best for a HOA not to have an unmoderated email list?

Other than that, I think I'll just sit back and be entertained.

I think its time for you to get out of the HOA's. You're not having any good luck with them.

Another illustration of why HOAs shouldn't allow HOA-owned resources to be used as a soap box for anyone. Even small spats between a few folks can poison a community's atmosphere, and if I were on the board I would be looking at creating Terms of Service and moderating the listserv for compliance.

Neither the property manager nor the owners are behaving in a responsible, business-like manner, and I would be glad to be outta there.

Email distribution lists aren't really listservs. I doubt any HOA or Condo association actually uses their own listserv.

Part 1:

The property manager sent an email to all owners in the HOA, "On behalf of the Board of Directors", attaching a "current list of owners in arrears, and a current list of amounts owed to the Association by such owners."

Of course, the list contained the names of people who the property manager was fighting with on email (along with numerous others).

Part 2:

Later that day, the property manager sent around an email to all owners in the HOA, stating, "The list of owners in arrears, and list of amounts owed, circulated earlier today, was inaccurate."

Doesn't this kind of nonsense put the HOA at risk--circulating wrong information about owners who allegedly owe amounts to the HOA--circulating a made-up list of debtors?

UPDATE

A news article in that city reports that the property manager has been arrested and charged with embezzlement.

The property manager is of course innocent until proven guilty but I think that this shows at least some justification for my concern about the property manager.
