My HOA is stating that because they don't have an Architectural Compliance Committee they don't need to enforce the building code Impact Insulation Class (IIC) for a new owner who removed carpeting and put in hardwood flooring.

Hi,

Not true at all. Committees are assembled to help with these sorts of issues, but it is ultimately the board that is responsible for enforcing rules.

If this is a building code issue, could you file a complaint with the agency who enforces it?

What do your own documents say, Brian? Don't you have a set of Architectural Guidelines? Don't your CC&Rs say something about architectural changes and flooring materials?

Is this a multi-story building or buildings? How many units?

Do you have a property manager? S/he if certified (should be!) should know something about this topic.

I'm not sure, but I don't think your local building dept. has any authority over this type of topic.
