I am new to this group but really need some help/advisement. We bought into the Jupiter-Palm-Beach Motor Coach Resort in Florida about six years ago as it was being developed. Two and a half years ago the developer sold it to another developer and things have gone downhill ever since. Last April they sold the 15th lot out of one hundred resulting in owners getting a seat on the Board. An "election" was held with email ballots by the developer even though no one had authorized the use of e-mail for official business. The ballots required you to sigh and put your lot number on the ballot itself. The developer chose who would count the ballots which was done at another site by one person. The developer/Board President pressured people to vote for his candidate even holding an Owner's meeting with only 24 hours notice to promote his candidate. He, his wife and his daughter who all "work" here" consistently "bad-mouthed" the other candidate
On another note he charges the HOA $48,000 to manage the Condo but does not possess the required licence. He runs his personal business, a mortgage Company out of the Common Element with no approval from the members and pays nothing for the utilities, heat, air, phone, water, etc.
These are just a few of the issues. I hired a lawyer because he said he would sit down with some of the owners and go over the problems and try to come up with a solution but when the meeting came he no-showed.

The attorney you hired didn’t show up for the meeting you hired him to attend?

I think you’ll need to provide waaaay more information for this to make sense.

Please review the site's Posting Rules. Specifically the one about no mentioning of names.

From what you describe, it sounds as if the developer did things properly but not the best way.
What was called email ballots was likely actually proxies.
Most corporate statutes allow for "emergency bylaws" and the pandemic could be argued as an emergency.
The Board, consisting of individuals hand picked by the developer, likely instituted such actions due to the pandemic.

Things will get better when the Association is controlled by the members.

Like it or not until under owner control you will be at the mercy of the owner/developer. Get use to it or sell.
